Direction to Counsel (from Mr. Justice Phelan)

FURTHER TO the Commissioner’s response regarding the expected date for the filing of the motion record in response for the hearing of the Respondent’s motion,

THE TRIBUNAL DIRECTS AS FOLLOWS:

  1. The hearing of the Notice of Motion filed by the Respondent, Vancouver Airport Authority (“VAA”), on April 9, 2018, requiring the Commissioner of Competition ("Commissioner") to produce certain documents or certain information over which the Commissioner refuses to produce on the basis of litigation privilege, will be held on April 30, 2018, in the hearing room of the Tribunal located at 610-90 Sparks Street, Ottawa, beginning at 9:30 a.m., for a maximum duration of one (1) day.
  2. The Tribunal confirms that VAA has served and filed its notice of motion and supporting affidavit on April 9, 2018.
  3. The Commissioner is to serve and file his response by April 13, 2018.
  4. The parties are to serve and file their respective Memorandum of Fact and Law by April 23, 2018.
