SCHEDULING ORDER

FURTHER TO the notice of application filed by the Commissioner of Competition against the Respondent for orders pursuant to section 90.1 of the Competition Act;

AND WHEREAS during their discussions concerning a draft scheduling order, the parties disagreed as to the time for and sequencing of their expert reports, particularly as to any efficiencies defence, which disagreement was the subject of a case management conference held on November 3, 2017;

AND FURTHER TO the Direction of the Tribunal, dated November 6, 2017, which resolved the issues raised at the November 3, 2017 case management conference and directed that certain dates be incorporated into the parties’ draft scheduling order;

AND FURTHER TO the draft scheduling order provided by the parties on November 24, 2017;

AND WHEREAS the Tribunal has examined the proposed scheduling order and is of the view that it is appropriate and respects the principles found in subsection 9(2) of the Competition Tribunal Act, RSC 1985, c 19 (2nd Supp);
THE TRIBUNAL ORDERS THAT:
