SCHEDULING ORDER


[1]  FURTHER TO the notice of application filed by the Applicant The Commissioner of Competition against the Respondent Moose International Inc. pursuant to section 74.1 of the Competition Act, RSC, c C-34, as amended;

[2]  AND FURTHER TO the draft scheduling order provided by the parties on July 18, 2016 and to the discussions with counsel for both parties at a case management conference held on August 4, 2016;

[3]  AND WHEREAS the Tribunal has examined the proposed scheduling order and is of the view that, with the various amendments agreed to by the parties at the case management conference, it is appropriate and respects the principles found in subsection 9(2) of the Competition Tribunal Act, RSC 1985, c 19 (2nd Supp.);

THE TRIBUNAL ORDERS THAT:

First week of hearing

Monday, March 6, 2017 – Thursday, March 9, 2017

Second week of hearing

Monday, March 13, 2017 – Tuesday, March 14, 2017

Third week of hearing (oral argument)

[6]  The Tribunal shall dispose of the Respondent’s future request that the Tribunal attend in Winnipeg to view the facilities used by the Respondent when the Respondent will file a motion to that effect.
