ORDER ADJOURNING THE HEARING OF THE APPLICATION

FURTHER TO the application filed by the Commissioner of Competition (the “Commissioner”) against the Respondents for orders pursuant to section 74.1 of the Competition Act, RSC 1985, c C-34, as amended (the “Act”) for conduct reviewable pursuant to paragraph 74.01(1)(a) and sections 74.05 and 74.011 of the Act;

AND FURTHER TO the case management conference of December 1, 2015, at which counsel for the Respondents asked for an adjournment of the hearing of the Commissioner’s application scheduled to commence on April 18, 2016;

AND WHEREAS counsel for the Commissioner does not oppose the Respondents’ request for adjournment and consents to an adjournment of the hearing to September 7, 2016;
[4]
AND WHEREAS subsection 9(2) of the Competition Tribunal Act, RSC 1985, c 19 (2nd Suppl.) provides that all proceedings before the Tribunal shall be dealt with as informally and expeditiously as the circumstances and considerations of fairness permit, and compelling reasons exist justifying the adjournment;
THE TRIBUNAL ORDERS THAT:

The six-week hearing of the Commissioner’s application is adjourned to September 7, 2016.

The parties shall consult with each other and agree on an amended timetable setting out new dates for the remaining pre-hearing steps. They shall file the timetable within 10 days from the date of this order, so that a new scheduling order can be issued.
