The Tribunal, having read the submissions filed by Nadeau Poultry Farm Limited and Groupe Westco Inc., has concerns with some agreed‐upon severances.
The parties are to correspond with the Tribunal Registry on or before Wednesday, August 5, 2009, with respect to the following:
(i) Whether the percentages found in paragraphs 29 and 30 are to remain confidential given the public version of the “Déclaration de Monsieur Rémi Faucher” filed by the Respondent Groupe Dynaco, Coopérative Agroalimentaire;
(ii) Whether the agreed‐upon severances found in paragraphs 33 and 34 are to remain confidential given the public nature of this information (be it the internet or information found in the written submissions filed by the Respondents Dynaco and Acadia and posted on the Tribunal website);
(iii) Whether the reference to the Serecon Report, as set out in paragraph 164, is confidential given that the Serecon Report was filed as a confidential exhibit to the Sanderson Report;
(iv) Whether Schedule A to the decision (Witnesses Presented by Each Party) contains confidential information.
