IN THE MATTER of the Competition Act, R.S.C. 1985, c. C-34, as amended; AND IN THE MATTER of an inquiry pursuant to subparagraph 10(1)(b)(ii) of the Competition Act relating to certain marketing practices of Premier Career Management Group Corp. and Minto Roy;

AND IN THE MATTER of an application by the Commissioner of Competition for an order under section 74.1 of the Competition Act.

ORDER EXTENDING THE TIME FOR SERVICE AND FILING OF A RESPONDING MOTION RECORD

[1] UPON being advised that the Respondents were served on September 13, 2007 with the applicant’s motion for an order in default of response;

[2] AND UPON noting that further to my order of July 31, 2007 responding material is due today;

[3] AND UPON being advised that the Respondents have just retained counsel who needs additional time to prepare responding material;

[4] AND UPON noting the Applicant’s submission that, if further time is to be granted, it should be only one week;

[5] AND UPON concluding that, in the circumstances of this case in which Mr. Roy’s Response was due on July 9, 2007 and the corporate Respondent’s Response was due on July 6, 2007, only a short extension of time is justified.

NOW THEREFORE THE TRIBUNAL ORDERS THAT: [6] The Respondents are to serve and file their motion record on or before Friday, October 12, 2007.

[7] The Record is to include the Respondents’ Response pursuant to Rule 5(2) of the Competition Tribunal Rules.

[8] Failing compliance with this order, the Applicant’s motion for a default order will proceed without further notice to the Respondents.
