Dear Ms. Seguin: Re: Sears Canada Inc. v. Christian Dior et al. I am writing to confirm that Madam Justice Simpson has adjourned the Application for Leave from Thursday, March 1, 2007 to Wednesday, March 14, 2007 at 1:00 p.m. The Application will proceed at the Competition Tribunal in Ottawa.
In addition, Madam Justice Simpson has indicated that, should leave be granted and an Interim Order is necessary to continue supply, this Application will proceed during the week of April 23, 2007.
These arrangements have been agreed upon on the understanding that the Respondents will resume supply in accordance with the usual terms which have applied between the Applicant and the Respondents until Friday, May 4, 2007, subject of course to a further Order of the Tribunal should that be necessary.
With respect to any material to be filed by the Respondents, counsel have agreed to work out an acceptable schedule without the necessity of a Scheduling Order from the Competition Tribunal.
