TAKE NOTICE that the Applicants TELUS Advertising Services Inc. and TELUS Advertising Services (Edmonton) Inc. hereby apply for an Order varying the Consent Order of the Competition Tribunal dated November 18, 1994 by adding the following paragraph, as more particularly set out in the attached Draft Consent Order:

The prohibition.ct contained in paragraph 3(b), (d), (f) and (g) shall not apply to the extent that they relate to dealings. agreements or arrangements between TELUS Advertising Services Inc. and TELUS Advertising Services (Edmonton) Inc. which do not otherwise affect the application of the said prohibitions to TELUS Advertising Services Inc. and TELUS Advertising Services (Edmonton) Inc.'s relationships with any other person.
2. AND FURTHER TAKE NOTICR that the variation proposed in this application represents a revi.sed version of the language proposed by the Applicants in their AppJ i cation filed on January 15, 1997.
3. AND FURTHER TAKE NOTICE that this application is brought by consent pursuant to sections 105 and 106(b) of the Competition Act, R.S.C. 1985. c. 19 (2nd Supp) as amended, and the Competition Tribunal Rules.
4. AND FURTIIER TAKE NOTICE that the grounds upon which the Application is brought is that the Director of Investigation and Research and the other Respondents have, through their counsel, consented to the granting of the within Order.
5. AND FUR1HER TAKE NOTICE that the parties are available for a conference call, at the Tribunal's convenience, to establish a schedule for the disposition of this application.
6. AND Fl JRTIIER TAKE NOTICE that the parties would be prepared to have the application dealt with by the Tribunal without the necessity of a hearing.
7. AND FURTHER TAKE NOTICE that reference may be made to the Consent Order Impact Statement, Affidavit of Michael Trebilcock, the Draft Consent Order and the Consent Fonn, filed herewith, and to such further and additional material as counsel deem appropriate and as this Tribunal may allow.
