FURTHER TO the agreement of counsel for the parties; THE TRIBUNAL ORDERS THAT: 1. Confidential documents filed by a party shall be accessible to counsel now acting ("successor counsel") for a party and to counsel for Covia Canada Corp. and Covia Canada Partnership Corp. on the same basis as such documents were accessible to previous counsel for the parties.

2. Successor counsel for a party and counsel for Covia Canada Corp. and Covia Canada Partnership Corp. may disclose confidential documents filed by PWA Corporation or the Director of Investigation and Research to their expert witnesses on the same terms as set out in the Order Regarding Confidentiality, issued in this proceeding on March 20, 1989.

- 3 -3. Nothing in this order purports to authorize access to confidential documents filed by the intervenors, it being understood that such access may be obtained by counsel for the parties with the consent of the intervenor that filed the confidential document.
