ORDER GRANTING THE MOTION OF THE COMMISSIONER OF COMPETITION TO FILE AN ADDITIONAL WITNESS STATEMENT

[1]  FURTHER TO the application filed by the applicant, the Commissioner of Competition (“Commissioner”), against the respondent, Vancouver Airport Authority (“VAA”), pursuant to section 79 of the Competition Act, RSC 1985, c C-34, as amended (“Application”);

[2]  AND FURTHER TO the Order Amending the Scheduling Order, dated March 2, 2018, which provides that the hearing of the Application is scheduled to commence on October 2, 2018, and sets out the deadlines for the filing of statements of witnesses the parties intend to call at the hearing;

[3]  AND FURTHER TO the informal motion of September 10, 2018 filed by the Commissioner in which he seeks permission to file the witness statement of Mr. Yiu, Vice President, Product, for Air Canada, because Mr. MacVittie, who previously provided witness statements on behalf of Air Canada, will no longer be working for the company;

[4]  AND WHEREAS VAA consents to the Commissioner’s motion;

THE TRIBUNAL ORDERS THAT:

[5]  The Commissioner’s motion to file the witness statement of Mr. Yiu is hereby granted and his witness statement is accepted for filing.
