The Respondents write in relation to the Order of the Honourable Mr. Justice Phelan dated October 17, 2018 and the Scheduling Order made in the above-noted matter. Please accept this letter as an informal motion requesting a case conference to deal with the issues described below.
The Respondents have dedicated significant time and resources toward complying with his Honour’s Order, but are unable to complete the production ordered by today’s date. As a consequence, the Respondents wish to convene a case conference to vary his Honour’s order with respect to specific categories of production.
In addition, the parties are unable to resolve an issue with respect to the scope of production for “transactional data” and require clarification or variance of the order with respect to that issue.
The parties are available to participate as early as November 8, 2018, as the Tribunal may be available.
