Direction to Counsel (from Mr. Justice Gascon, Chairperson)

FURTHER TO the letter of Thoma Bravo, LLC’s (“Thoma Bravo”) counsel, filed on July 25, 2019 seeking a twenty-one (21) day extension of the period for delivery of Thoma Bravo’s Response to the Commissioner of Competition’s (“Commissioner”) application under section 92 of the Competition Act, RCS 1985, c. C-34;

AND FURTHER TO the Commissioner’s written consent to Thoma Bravo’s request, as set out in Appendix I to the letter;

AND FURTHER TO Rule 2(1) of the Competition Tribunal Rules, SOR/2008-141, which provides that the Tribunal may vary the application of a Rule in a particular case in order to deal with all matters as informally and expeditiously as the circumstances and considerations of fairness permit, and Rule 5 which provides that the time limits prescribed by the Rules may only be shortened or extended by an order or direction;

THE TRIBUNAL DIRECTS AS FOLLOWS:

Thoma Bravo’s request for a 21-day extension of the period for delivery of its Response is granted and the Response shall be served and filed with proof of service on or before Monday, August 19, 2019.
