Re: Update on schedule further to the Tribunal’s updated Notice regarding the COVID-19 Pandemic
Further to the Tribunal’s Scheduling Order dated March 4, 2020, and further to the Tribunal’s Updated Notice regarding the COVID-19 Pandemic dated April 15, 2020 (“COVID-19 Notice”), and considering that the Scheduling Order currently provides for certain steps to be completed during the Suspension Period (as defined in the COVID-19 Notice), the Tribunal directs counsel for the parties to consult with each other and to inform the Tribunal, by the end of the day on Monday, April 20, 2020, as to whether:
• The dates for the first two steps contemplated in paragraph 5 of the Scheduling Order need to be amended, in light of the COVID-19 Notice and the Suspension Period;
• The motions contemplated at the third step of paragraph 5 of the Scheduling Order, if any, could be heard by the Tribunal by telephone or video conference, assuming the parties would be ready to proceed on May 25, 2020 as set out in the Scheduling Order;
• The dates for any other steps contemplated in the Scheduling Order need to be amended, in light of the COVID-19 Notice and the Suspension Period.
Unless the parties advise otherwise, the Tribunal assumes, at this point in time, that the parties will be ready to proceed with the hearing of the Commissioner’s Application on the November and December 2020 dates currently set aside in the Scheduling Order.
Should counsel for the parties consider that a case management conference would be helpful to discuss any issues relating to the timetable for this Application, they shall inform the Tribunal accordingly and indicate, by the end of the day on Monday, April 20, 2020, the days and times at which they would be available for such case management conference between Tuesday, April 21, 2020 and Friday, April 24, 2020. The case management conference would be held by telephone conference.
