ORDER FOLLOWING THE CASE MANAGEMENT CONFERENCE OF SEPTEMBER 4, 2020

[1]  FURTHER TO the application filed by the Commissioner of Competition (“Applicant”) on December 19, 2019 against the Respondent Parrish & Heimbecker, Limited (“Respondent”), pursuant to section 92 of the Competition Act, RSC 1985, c C-34 (“Act”), with respect to the acquisition by the Respondent of a primary grain elevator located in Virden, Manitoba;

[2]  AND FURTHER TO the Scheduling Order issued by the Tribunal on March 4, 2020 which sets out various steps of the mediation process; 

[3]  AND FURTHER TO the Order Amending the Scheduling Order dated April 21, 2020 (“Amended Scheduling Order”);

[4]  AND FURTHER TO the Case Management Conference held on September 4, 2020 at which counsel for both parties asked the Tribunal to vary the time limits associated with certain steps of the mediation process given their discussion with Chief Justice Crampton, the mediator in this matter, during a pre-mediation teleconference;

THE TRIBUNAL ORDERS THAT:

Monday, September 14, 2020  Applicant to deliver mediation brief

Wednesday, September 16, 2020  Respondent to deliver mediation brief

  Wednesday, September 23, 2020   Mediation to be conducted virtually, over Zoom.

   The parties will be contacted by the Tribunal Registry for the purposes of making the appropriate logistical arrangements.
