Re: Case Management Conference
Further to the informal requests made by the Tribunal Registry since the Case Management Conference held on October 28, 2020, regarding possible alternative dates for the hearing of the Application, and further to the email received from counsel for the Applicant on November 3, 2020 indicating that the parties disagree on the date on which the hearing should commence, the Tribunal hereby directs that counsel for each party shall be prepared to propose, at the Case Management Conference to be held on November 5, 2020 at 4:00 p.m. (“CMC”), a precise schedule for the evidentiary portion of the hearing (for both the testimony of lay witnesses and expert witnesses) and for the oral argument which shall fit within the following dates on which the Tribunal can be available: December 7 to 11, 2020; December 14 to 16, 2020; January 4 to 7, 2021; January 11 to 15, 2021; and January 18 to 22, 2021. If the parties cannot agree on a proposed schedule, the Tribunal intends to issue, after having heard the submissions of the parties at the CMC, an amended Scheduling Order fixing the new dates for the hearing of the Application within the above-mentioned timeframe, along with corresponding revised dates for the remaining pre-hearing steps.”
