Direction to Counsel (from Mr. Justice Gascon, Chairperson)

 

Further to the case management conference held on November 12, 2020, the Tribunal directs as follows:

 

  1. Counsel for each party shall serve and file, on or before Friday, November 27, 2020, requests to designate as confidential “Level B Protected” (as the term is defined in the Confidentiality Order of March 4, 2020) any information that could identify a witness who is reasonably concerned about the public disclosure of his / her identity, along with a short summary of the grounds for such requests.

  2. Counsel for the parties shall file with the Tribunal, on or before Friday, November 27, 2020, their joint comments and proposed changes, if any, to the draft Directions on “Chess-clock and Sitting Times” and on “Concurrent Evidence Session (“Hot-tubbing”) for Expert Witnesses” sent by the Tribunal on November 13, 2020.

  3. Counsel for the parties shall inform the Tribunal, on or before Friday, November 27, 2020, of the status of their discussions on the format to be retained by the Tribunal for the first two weeks of the evidentiary portion of the hearing.

  4. Counsel for each party shall file with the Tribunal, on or before Friday, December 4, 2020, the list of individuals who intend to view the hearing remotely (whether completely or in part) and who are authorized to attend in camera sessions in accordance with the Tribunal’s Confidentiality Order.

  5. The jointly prepared witness schedule, including the list of witnesses, when each witness is scheduled to be called, the anticipated duration of examination-in-chief and cross-examination of each witness, the time constraints that any witness may have, any requests for witness exclusions and the need for visual displays or other technical support shall be filed with the Tribunal on or before Friday, December 18, 2020.

  6. On or before Friday, December 18, 2020, the parties shall notify the Tribunal as to the anticipated duration of their opening statements and whether they intend to file written opening submissions.

  7. The parties shall file their position on costs with the Tribunal on or before Monday, February 1, 2021, one business day before the start of final oral argument.

  8. The parties will be allowed to file final written submissions not exceeding 50 pages in length, along with a compendium containing the relevant excerpts of evidence and authorities they intend to rely upon. These written submissions and compendia shall be filed with the Tribunal on or before Monday, February 1, 2021, one business day before the start of final oral argument.
