FURTHER TO the motion record and memorandum of fact and law filed on November 27, 2020 by the Applicant, the Commissioner of Competition (“Commissioner”), challenging the admissibility of certain proposed evidence from Mr. John Heimbecker, one of the proposed witnesses of the Respondent, Parrish & Heimbecker, Limited (“P & H”);
AND FURTHER TO the Order Establishing a Further Amended Schedule for the Remaining Pre-Hearing Steps and the Hearing, dated November 13, 2020, which provides that the hearing of such motion shall take place on December 4, 2020;
THE TRIBUNAL DIRECTS AS FOLLOWS:
- The hearing of the Commissioner’s motion will be held on Friday, December 4, 2020, by way of video conference, beginning at 9:30 a.m. Ottawa time, for a maximum duration of two (2) hours.
- P & H is to serve and file its responding record and its memorandum of fact and law by 4:30 p.m. Ottawa time on Wednesday, December 2, 2020.
