Re: Timetable

 

Further to the filing of the Commissioner of Competition’s Reply on January 28, 2022, the Tribunal reminds the parties and their counsel that, pursuant to section 40 of the Competition Tribunal Rules, SOR/2008-141, the parties were also required, within 14 days after the expiry of the period for filing a response (i.e., on January 28, 2022), to file their proposed timetable for the disposition of the application, including a suggested start date, duration and place for the hearing, if a timetable is agreed upon. If the parties were not able to agree on such timetable, each party was required, pursuant to subsection 40(2), to serve on the other party a proposed timetable and to file it at the Tribunal with proof of service, within the same 14-day timeframe.

 

Since both parties have failed to do so, the Tribunal hereby directs the parties to file (and serve if necessary) such proposed timetable(s) by the end of the day on February 1, 2022.

 

Following receipt of the parties’ proposed timetable(s), the Tribunal will convene a case management conference to discuss and finalize the scheduling order to be issued by the Tribunal in this matter.
