Re: Scheduling of Two Interlocutory Motions – Videotron Motion to Intervene and Commissioner’s Motion to Amend the Scheduling Order for the section 92 Application

As contemplated at the outset of the Case Management Conference (“CMC”) on Friday, July 29, 2022, Justice Little has further considered the letter dated July 29, 2022, from counsel for the Commissioner and the letter dated July 29, 2022, from counsel for Videotron (both received shortly before that CMC) and has also reviewed the reply materials filed by Videotron after the CMC.

Justice Little recognizes and appreciates the efforts of counsel to address the issue of his ability to hear the Videotron motion and the Commissioner’s motion to vary the Scheduling Order. However, after further reflection, Justice Little remains of the view that he is unable to hear these interlocutory motions.

Counsel for the parties and for Videotron are therefore directed to attend a CMC with Chief Justice Crampton on Thursday, August 4, 2022, at 1:00 pm ET, by videoconference to address the following:

  • (a) whether the Scheduling Order should be varied to postpone the examinations for discovery scheduled for the weeks of August 15 and 22, 2022;

  • (b) a date for the hearing of these two interlocutory motions, and interim filing deadlines.

The Registry will provide counsel with a link to the videoconference by email.
