Re: Hearing Format and Upcoming CMC
Having considered the parties’ positions with respect to the hearing format during the Case Management Conference (CMC) held on September 26, 2022, the Tribunal confirms that the hearing in this proceeding will be held by videoconference, as contemplated in the Scheduling Order dated June 17, 2022.
In light of the Commissioner’s email communication to the Registry dated September 26, 2022, the Tribunal directs that counsel attend a CMC on Friday, October 7, 2022, at 11:00 AM (Eastern time). The agenda will include the anticipated length of the hearing and Chess Clock time allocation. Counsel are encouraged to discuss these and other issues related to the hearing in the meantime, together with any other issues of concern.
