Re: Closing Arguments

 

Further to the completion of the evidentiary portion of the hearing and the exchange with respect to oral arguments that took place between the Presiding Member and counsel to the parties on Thursday, December 1st, 2022, the Tribunal directs as follows:

 

  1. In accordance with the Scheduling Order, parties are to file their written arguments with the Tribunal Registry by the close of business on Thursday, December 8, 2022:

 

  • Each of the Parties shall limit their written arguments to a maximum of 75 pages, doubled-spaced

    • o For greater clarity, there shall be a single 75 page limit for the combined submissions of the Respondents and the Intervener

  • Written submissions may be accompanied by a maximum of 20 pages of appendices, which may be comprised of material such as charts or tables but shall not include anything resembling written submissions.

 

  1. Any compendia to accompany oral argument shall be filed with the Tribunal Registry by Monday, December 12, 2022:
  • Each of the Commissioner, the Respondents, and the Intervenor may file their own compendium.

 

  1. Parties are requested to send two (2) paper copy of the written arguments and the document compendia to Chief Justice Paul Crampton’s Chambers:
