Re: Submissions on Costs

Having regard to the exchange between the panel and the parties regarding costs at the end of the hearing (see Transcript, at pp. 3536-3537);

And considering the panel’s understanding that the parties’ submissions regarding costs remain outstanding;

The parties are directed to provide their submissions regarding costs by the close of business on February 10, 2023. In the interest of saving time and costs for all involved, the parties are encouraged to reach an agreement regarding a lump sum amount, separate and apart from disbursements, that would be payable to the prevailing party.

If the parties are unable to reach an agreement, they shall provide submissions, not exceeding five pages each. In that eventuality, each party is once again requested to give serious consideration to requesting a lump sum award. Each party shall also file a summary of their respective bills of costs that is sufficiently detailed to permit the Tribunal to assess the appropriateness of any such lump sum amount.
