NOTICE PURSUANT TO SUBSECTION 103.1(5) OF THE COMPETITION ACT
[1] WHEREAS an application was filed on September 29, 2023 by Apotex Inc. pursuant to subsection 103.1(1) of the Competition Act, RSC 1985, c C-34 (“Act”) for an Order granting it leave to make an application under section 79 of the Act (and an amended application was filed on October 3, 2023);
[2] AND WHEREAS, pursuant to subsection 103.1(3) of the Act, the Commissioner of Competition (“Commissioner”) certified, in a letter filed on October 3, 2023 that this matter is not currently the subject of an inquiry nor was it the subject of an inquiry that has been discontinued because of a settlement between the Commissioner and the persons against whom an order is sought;
