ORDER AMENDING THE SCHEDULING ORDER
[1] FURTHER TO the application filed by the Commissioner of Competition (the “Applicant” or the “Commissioner”) on May 18, 2023 against Cineplex Inc. (the “Respondent” or “Cineplex”) (collectively, the “Parties”) for an order under sections 74.01 and 74.1 of the Competition Act, RSC 1985, c C-34 (the “Application”);
[2] AND FURTHER TO the Scheduling Order (“Scheduling Order”) issued by the Tribunal on August 31, 2023, which sets out various steps for the mediation process;
[3] AND FURTHER TO a pre-mediation conference held on December 19, 2023, at which the mediation process was discussed with Chief Justice Crampton, the mediator in this matter, including with respect to its scheduling, and written confirmation by the parties on December 20, 2023 that they agreed to modify certain dates in respect of the mediation;
THE TRIBUNAL ORDERS THAT:
[4] The Scheduling Order is amended as follows:
Thursday, January 18, 2024 Deadline for Parties to exchange Mediation Briefs and to deliver them to the Mediator via the Tribunal Registry
Tuesday, January 23, 2024 Mediation
[5] The mediator may provide further directions to the parties with respect to the mediation and may extend or alter the schedule related to mediation including the dates above without further Order of the Tribunal.
