ORDER GRANTING AN EXTENSION OF TIME [1] FURTHER TO an application filed by the Commissioner of Competition (“Commissioner”) on November 28, 2024, against Google Canada Corporation and Google LLC (together, “Google”) under section 79 of the Competition Act, RSC 1985, c C-34;

[2] AND FURTHER TO an Order dated December 20, 2024, which granted Google an extension of the period of time to serve and file its response under Rule 38 to February 14, 2025;

[3] AND UPON BEING ADVISED that on or about February 25, 2025, the Commissioner sent Google a Demand for Particulars in respect of Google’s response; and that Google expects to provide a response to the Demand for Particulars within the next 7 to 10 days;

[4] AND FURTHER TO an informal motion from the Commissioner dated February 26, 2025, seeking an extension of the period of time to serve and file his reply under Rule 39 until two weeks after Google has served and filed its response to the Demand for Particulars;

[5] AND FURTHER TO a case management conference held on February 27, 2025, in which the Commissioner reiterated and further explained his request for an extension of time;

[6] AND CONSIDERING that Rule 5 of the Competition Tribunal Rules states that time limits prescribed by these Rules may only be extended by an order or a direction of a judicial member;

[7] AND CONSIDERING the consent of Google to an extension of the period of time for the Commissioner to serve and file its reply until two weeks after Google has served and filed its response to the Commissioner’s Demand for Particulars;

THE TRIBUNAL ORDERS THAT: [8] The period of time for the Commissioner to serve and file his reply under Rule 39 is extended until two weeks after Google has served and filed its response to the Commissioner’s Demand for Particulars.

There is no costs order for this motion.
