May 22, 2025 BY EMAIL Competition Tribunal Attn: Tribunal Registry Thomas D'Arcy McGee Building 90 Sparks Street, Suite 600 Ottawa, ON K1P 5B4

Dear Registry: Commissioner of Competition v. Google Canada et al. (CT-2024-010) We ask that you please bring this letter to Justice Little’s attention. We write further to the Commissioner’s correspondence of May 21, 2025 regarding his proposed motion to strike Google’s constitutional challenge under the Charter and Bill of Rights.

We request that the Tribunal schedule a case management conference next week, or as soon thereafter as the Tribunal is available, to discuss the proposed motion.

Google firmly believes that the proposed motion of the Commissioner is improper and should not be scheduled or heard, including for the reasons set forth in my letter to the Commissioner’s counsel of May 21, 2025. My letter was enclosed with the Commissioner’s materials sent to the Registry yesterday.

Respectfully submitted,
