Good afternoon: We write on behalf of both parties with respect to the scheduling order in the above referenced matter for two reasons.
First, the scheduling order requires that examinations occur between August 25, 2025 to September 5, 2025 and contemplates that a judicial member will be available on dates and times to be agreed to with counsel for the Parties to rule on objections arising during the examinations. The parties have agreed to schedule discoveries for August 27-29 and September 3-5 to start at 10 am and finish at 5 pm should a judicial member be required.
Second, the parties confirm that Rogers legal counsel is available for the hearing dates scheduled in paragraphs 8 and 9 of the scheduling order. The parties no longer need the alternative hearing dates in paragraph 10.
