Re: Case Management Conference – Motion for Direction

 

FURTHER TO the receipt of the Commissioner of Competition’s Memorandum of Fact and Law dated December 30, 2025, in advance of the Case Management Conference where the Motion for Direction is to be heard on January 7, 2026; the request from Rogers dated December 31, 2025, that the hearing of the Motion for Direction be adjourned, including due to the unexpected receipt of the Commissioner Memorandum as well as time constraints; and the reply of the Commissioner dated December 31, 2025, seeking that Rogers’ request be denied;

 

THE TRIBUNAL DIRECTS AS FOLLOWS:

 

  1. The Commissioner’s Motion for Direction will be heard as scheduled on January 7, 2026, at 1:00 p.m. via the Zoom platform.

 

  1. Rogers is to provide its response by 5:00 p.m. on January 6, 2026. Whether or not Rogers files a Memorandum of Fact and Law concurrently with its response does not preclude Rogers to make any arguments orally during the hearing of the Motion for Direction.
