ORDER AMENDING THE SCHEDULING ORDER
[1] CONSIDERING a letter from counsel to the respondents received on Friday, February 20, 2026, which informed the Tribunal that the respondents seek a variation to the Scheduling Order issued on August 28, 2025, to postpone sine die the mediation currently scheduled to take place on Wednesday, March 25, 2026, because they consider that a mediation would not be beneficial at this time, but may be of assistance at a later stage;
[2] AND CONSIDERING that the applicant does not oppose the respondents’ request to vary the Scheduling Order;
[3] AND CONSIDERING that mediation is a voluntary and consensual process;
THE TRIBUNAL ORDERS THAT:
[4] The Scheduling Order is amended to remove the mediation (and related steps) currently scheduled to take place on Wednesday, March 25, 2026.
[5] If the parties determine that mediation may be beneficial at a later date, they are directed to inform the Tribunal at their earliest convenience, and preferably at least six weeks prior
[5]to any proposed mediation date, if they intend to seek the participation of a Tribunal member as
[5]mediator.
