FURTHER TO the joint submission filed by the parties with respect to scheduling; AND UPON consultation with the parties; THE TRIBUNAL ORDERS THAT: 1. The hearing of the application shall commence on Monday, November 17, 1997 at 10:00 a.m. before the Competition Tribunal sitting at the Federal Court of Canada, 700 W. Georgia Street, Vancouver, British Columbia.
2. The following schedule for prehearing procedures shall be observed: September 8, 1997 Deadline to serve and file any requests for leave to intervene September 12, 1997 Responses to requests to intervene served and filed and affidavits of documents served and filed
September 17, 1997 Pre-hearing conference re requests to intervene and issues arising from discovery to date
September 29, 1997 Examinations for discovery to be completed October 6, 1997 Pre-hearing conference (conference call at 12 noon (EDT)) re issues arising from examinations for discovery, and conduct of the hearing (if feasible)
October 17, 1997 Exchange of expert affidavits pursuant to section 47 of the Competition Tribunal Rules
October 31, 1997 Exchange of rebuttal expert affidavits pursuant to section 47 of the Competition Tribunal Rules
November 7, 1997 Filing of all expert affidavits pursuant to section 48 of the Competition Tribunal Rules
November 13, 1997 Pre-hearing conference (conference call at 12 noon (EST)) 3. It is understood that if in the course of the proceedings counsel for the parties agree that any of the pre-hearing conferences listed above become unnecessary or are not appropriate to be held by conference call, counsel shall so inform the Registrar.
