Re: Modifications to the Scheduling Order
FURTHER TO an order issued by this Tribunal on November 7, 2025, which among other things granted a motion by Rogers to amend its response to the Commissioner’s application (the Application) in order to challenge the constitutionality of the administrative monetary penalty regime contained in section 74.1(1)(c)(ii) of the Competition Act (the “Constitutional Challenge”); and discussions that took place during a Case Management Conference on November 24, 2025, whereby the parties sought, on consent, to make some modifications to this matter’s Scheduling Order dated March 26, 2025;
THE TRIBUNAL DIRECTS AS FOLLOWS:

By Friday, January 9, 2026, Rogers shall serve and file its materials in the Constitutional Challenge.

By Wednesday, February 18, 2026, the Commissioner shall serve and file his responding materials in the Constitutional Challenge.

By Wednesday, March 11, 2026, Rogers shall serve and file its reply materials in the Constitutional Challenge.

The evidentiary portion of the hearing of the Application is amended to include Monday, April 13, 2026.

The argument portion of the hearing of the Application is amended to include Friday, May 1, 2026.

All other steps and dates remain unchanged.
