We have shared a draft of this correspondence with counsel for the Applicant, 8X Labs Inc. ("8X"), who have approved of its contents and are copied. We write to advise that, subject to the Tribunal's permission, the parties have agreed upon the following proposed schedule for the exchange of materials and other steps in the proceeding:

January 20, 2026 – Vistar to file an informal motion with the Tribunal for leave to file responding evidence, including any draft responding affidavit(s). We understand that the Applicant will most likely contest such informal motion;
14 days after the Tribunal's decision regarding Vistar's motion for leave to file responding evidence – Vistar to serve and file responding written argument and, if leave is granted, responding evidence, including any final responding affidavit(s); and
15 days after Vistar serves its responding evidence (if leave is granted) and written argument – 8X to serve and file reply written argument.
We kindly ask for the Tribunal's approval of the parties' above-proposed timetable. The parties believe that these timelines are appropriate given the upcoming holidays and all parties' consent.
