Direction to Counsel (from Mr. Justice Little, Chairperson) Re: Scheduling and Extensions of Time The Tribunal has received the letter dated December 22, 2025, from counsel for Vistar Media Inc. concerning the scheduling of steps towards the determination of an application dated November 27, 2025, by 8X Labs Inc. for leave under section 103.1 of the Competition Act, RSC, 1985, c C-34.
On consent of 8X Labs Inc. and Vistar Media Inc., the following timetable shall apply and the time for taking these steps is extended until the dates indicated:
1. By January 20, 2026, Vistar Media Inc. may seek leave to file responding affidavit evidence under Rule 119(3) of the Competition Tribunal Rules, SOR/2008-141. A future Direction will establish the filing deadlines for subsequent steps on this motion.
2. Within 14 days after the Tribunal’s decision on the motion for leave to file responding affidavit evidence, Vistar Media Inc. may serve and file responding written representations pursuant to Rules 119(1) and (2) and, if leave is granted, responding affidavit evidence pursuant to Rule 119(3).
3. The time for the Commissioner of Competition to file written representations under subsection 103.1(6) of the Competition Act is extended to the date in paragraph 2.
4. Within 15 days after service of the responding representations of Vistar Media Inc. and the Commissioner of Competition, if any, 8X Labs Inc. may serve and file reply written representations under Rule 120.
