I represent The Samuelson-Glushko Canadian Internet Policy and Public Interest Clinic (“CIPPIC”), the applicant in the above noted case, which was filed with the Tribunal.

We are writing to seek an extension to serve one of the respondents, Apple Inc., located at One Apple Park Way, Cupertino, CA 95014, U.S.A, with the Notice of Application for leave under section 103.1 of the Competition Act.

We attempted to serve the respondent at their listed address on December 24, 2025. Upon arrival our Process Server was informed by security that the building would be closed for the holidays until January 2, 2026 and only security would be on the premises. A copy of our Affidavit of Attempted Service on Apple Inc is enclosed for more information. The closure of Apple Inc., until January 2, 2026 does not allow us to meet the 5-business day deadline to serve our materials for leave.

We therefore request that the Tribunal grant an extension to serve the leave application materials on the respondent, Apple Inc.

1. On December 24, 2025 at 9:23AM,Iattempted to serve Apple Inc. with the Notice of Application for leave under section 103.1 of the Competition Act, Proposed Notice of Application, Memorandum of Fact and Law, Affidavit of David Fewer, Affidavit of Luca Bellisario and Affidavit ofKelli Fairbrother in support of the Notice of Application pursuant to s. 103., at One Apple Park Way, Cupertino,CA 95014,U.S.A.

2. Iwas advised by a security guard at Gate IC who identified himself as Xavier Doe that the business was closed for two weeks and that no one would be present in the office.I subsequently entered a different entrance, where I spoke withan individual who refused to identify himself. Description: Hispanic male, approximately 35-45 years of age, black hair, brown eyes, seated ina security vehicle. He stated that all offices were closeduntil January 2 and advised that all legal documents should be directed to the following address: 19319 Stevens

Creek Blvd, Cupertfao, CA 95014.

3. On December 24, 2025 at 11:44AM, 1 attempted to serve Apple Inc. at the alternate address at 19319 Stevens Creek Blvd, Cupertino, CA 95014, as directed by staff at the prior location. Upon arrival, I found the building closed. . I also attempted service at an adjacent unit; however, that location was also closed.
