NOTICE UNDER SUBSECTION 103.1(5) OF THE COMPETITION ACT

[1] WHEREAS an application was filed on March 26, 2026, by Whitecap Partnership by its managing partner Whitecap Resources Inc., under subsection 103.1(1) of the Competition Act, RSC 1985, c C-34 for an order granting it leave to make an application under section 74.1 of the Competition Act;

[2] AND WHEREAS pursuant to subsection 103.1(3) of the Competition Act, the Commissioner of Competition certified, in a letter received on April 9, 2026, that this matter is not currently the subject of an inquiry nor was it the subject of an inquiry that has been discontinued because of a settlement between the Commissioner and the person against whom an order is sought;

TAKE NOTICE THAT:

[3] The Competition Tribunal confirms that it can hear this application for leave.
